According to reports:
Baby Dalke was born in St. Peter’s Hospital of Helena, MT the morning of May 28, 2019, with a respiratory infection.
The child was taken into State custody on May 29, 2019 and remained in the hospital.
The reasons given by the State for taking custody were:
“Concerns of inability to take appropriate care. Inability
or unwillingness to cooperate with the department.”
A show cause hearing before a district judge was to be scheduled some time shortly after the removal of the child from the mother’s custody. Details regarding that proceeding are not known. The purpose of the show cause hearing is to determine whether the removal was appropriate and whether custody should remain with the State or be returned to the mother.
The mother, Samantha (Sammy) Dalke, was discharged from the hospital on May 30, 2019.
Amber Stob (aka AJ Tabitha Love HartStob), an activist of sorts local to Helena, picked up on the case and took to FaceBook to promote Sammy’s anti-CPS position and such is recorded on various posts to her FaceBook page such as shown below:

In one of the video’s posted by Amber Stob (AJ Tabitha Love HartStob), Amber states that Sammy is mentally handicapped and refers to her speech impediment.
Amber Stob has also indicated that Montana State Representative Rodney Garcia is involved on behalf of Sammy.
Sammy has also indicated in FaceBook postings that she had 3 other children which in days gone by were all removed from her custody and that her parental rights as to them were terminated.

I will try to keep up with the substantive develops in the case and post updates.
The Montana Code, 41-3-301 provides, in relevant part:
“Any child protective social worker of the department, a peace officer, or the county attorney who has reason to believe any child is in immediate or apparent danger of harm may immediately remove the child and place the child in a protective facility.
.
After ensuring that the child is safe, the department may make a request for further assistance from the law enforcement agency or take appropriate legal action.
.
The person or agency placing the child shall notify the parents, parent, guardian, or other person having physical or legal custody of the child of the placement at the time the placement is made or as soon after placement as possible.
.
Notification under this subsection must include the reason for removal, information regarding the show cause hearing, and the purpose of the show cause hearing and must advise the parents, parent, guardian, or other person having physical or legal custody of the child that the parents, parent, guardian, or other person may have a support person present during any in-person meeting with the social worker concerning emergency protective services.”

Will this be a case to show overreach by Child Protective Services?

I’m getting the impression that Garcia may be a political joke in Montana. He doesn’t appear to realize that Montana State Law allows for the removal of children without a warrant. Image and words below taken from above YouTube interview.

Update June 3, 2019
Strausie reported to me this evening, via FaceBook Messenger, before blocking me, that they had their meeting with Rep. Garcia, who could not get CPS to cooperate in his investigation (no surprise there) and that Rep. Garcia was going to file a lawsuit against the hospital. Strausie also indicated that the show cause hearing had not yet been scheduled (maybe it has, maybe not).
After that discussion, I noticed that Amber Stob (aka AJ Tabitha Love HartStob), with whom I had also had previous contact, had also blocked me and that her latest FaceBook post is as shown below. Makes me wonder if they are talking about me.
In my communications with both of those women, local activists to the Sammy Dalke community, it should have been clear I was not sympathetic to what they were doing.

Sammy Dalke has now blocked me from her personal FaceBook page, but I noticed that she posted the following yesterday, after her reported court date, and without discussing the details of her case. It indicates that it was really crafted by Sammy, who is, reportedly, mentally challenged.
I think this is more evidence that Sammy is being exploited by those who should know better within the anti-government, anti-CPS movement in Montana.

Woman in court for abuse of infant

A Great Falls woman is charged with felony child abuse for allegedly injuring her 3-month-old child. Samantha Villareal-Dalke made her initial appearance Thursday on one count of assault on a minor, a felony.
Court documents say the infant’s baby sitter reported suspicious injuries to the police. The document said the child had a black eye and an abrasion over his left eye. The report says the sitter had been watching the child overnight frequently and the injuries occurred between times she provided care earlier this week.
The report says Villareal-Dalke initially said the infant scratched himself, then said he hit himself with his own hand and finally said the child “head-butts” people who hold him when he is frustrated. She also reported something fell on the infant in his crib, but this claim was unfounded.
A male at the home told investigators he could tell Villareal-Drake was growing frustrated with the baby. He also said Villareal-Dalke “has mental issues” and cried when asked about the baby’s injury.
Villareal-Dalke told police she didn’t seek medical treatment for her child because she was afraid people would think she was abusing him. Medical professionals told investigators the injury did not appear to be self-inflicted or accidental.
The state requested bail be set at $10,000.

Strausie Hart has been propogandizing again, all the while providing no information regarding Sammy’s efforts to get a new lawyer or convince the State she is a willing and able person to be given a child to care for. My panel of experts tell me Strausie is misrepresenting the stress the child might be under and the problems. Well, it sounds almost official.
That is, despite my best efforts to help insure the Sammy Dalke case would “go national” as the early promoters were claiming, the Montana anti-CPS movement, and others, refused to get behind it and make it happen.

The problem is not that “we” are not listening, it’s that Sammy and her promoters are not listening and acting consistent with any serious interest in parenting Sammy’s youngest child.

One of my agents was able to intercept some old correspondence involving Jamie Johnson’s Family Rights Protection Foundation. It reveals that while Sammy was early on in her 4th pregnancy that she was reaching out to Jamie Johnson (aka Family Rights Protection Foundation) for help. Jamie is another fruitcake, wannabe activist who has developed quite a reputation for herself, but not based on help actually provided to needy folks.
Apparently Jamie was no help to Sammy and Sammy went elsewhere for help which never came; at least not the help she wanted and she refused the help she needs.

So, the picture I get is Strausie is trying to impress some of her new judicial accountability friends and is talking about last summer’s ordeal with Sammy which, not previously reported that I recall, the judge told Strausie she was not fit to receive Sammy’s child into her home pending Strausie’s successful efforts at reunification.
Sounds to me like the judge got it right, if that’s what this is all about.

Sammy Dalke has pretty much dropped out of sight, but her #1 promoters Strausie Hart and AJ (aka Amber Williams) continue their efforts to make a name for themselves. AJ is on the verge of filing 5 lawsuits (the details of which have yet to be revealed).

For some reason, Strausie Hart posted this document today. I don’t think it has been posted earlier; at least not in this article. So, here it is; explaining why Sammy’s newborn was removed by the State of Montana. Strausie provided no update as to what is up with Sammy and any continuing efforts she may be taking to try and get her child returned to her custody.

I guess there was some delay. In a broadcast today, Strausie Hart announced that Sammy Dalke’s child was adopted “yesterday”; making 4 that Sammy has given up to the child welfare system because she is an unfit mother. The announcement is around the 1:25 mark in the video at the following link:
