The relationship between Kent Hovind and Mary Tocco was officiated by the Texas preacher Eric Philpott and was memorialized in a Hovind video that has since been removed as shown below:

In recent weeks it has been noted that Kent Hovind and Mary Tocco have not been living together as husband and wife for many months and that Kent Hovind has begun living together with Cindi Lincoln in a relationship that has yet to be publicly announced.

Jo Hovind, Kent Hovind’s first wife formally, legally, civilly divorced Kent Hovind in a proceeding of record in Escambia County, FL. Kent Hovind did not contest that divorce in the Spring of 2016 and took up living with Mary Tocco in September 2016 after the event noted above which was publicized worldwide via various YouTube broadcasts on Kent Hovind’s YouTube channel and elsewhere.

The State of Alabama accepted as legally binding common-law marriages contracted in 2016 and continued to accept such marriages subsequent to 2016. Since 2016 Alabama no longer recognizes such marriages contracted after 2016.

There are no provisions for common-law divorces/annulments. Common-law marriages require civil, legal, on-the-record action in order to legally dissolve them.

Despite repeated requests, there has been no formal, public, official explanation as to how Kent Hovind and Mary Tocco might propose that their marriage was dissolved.

Cryptic and unofficial statements indicate simply that the marriage of Kent Hovind and Mary Tocco was NOT legally, civilly, on-the-record dissolved; indicating that they remain married as a matter of law.

Mary Tocco indicated in one statement that Kent Hovind “renounced” the marriage and in another statement Kent’s man Ernie Land indicated that Kent arranged for a private “common-law” ceremony where he dissolved the marriage before witnesses; after which Mary received some kind of email or text notice of the action.

My Conclusion/Opinion
.
As a matter of law, Kent Hovind and Mary Tocco remain married and Kent Hovind’s relationship to Cindi Lincoln is merely one of 2 consenting adults living together (perhaps in a bigamous relationship).

Kent Hovind parades out Cindi Lincoln in his latest performance without mentioning who she is or what their relationship is. Perhaps it was Kent’s way of responding to friends and family of Cindi Lincoln who have been expressing concerns about her well-being.

As far as I can tell, that marriage is still legally, civilly binding.

It appears Mary Tocco, instead of letting her lawyers get her a civil, legal, divorce, is trying to change history by getting Wikipedia to accept her claims about what kind of relationship they had and edit their section on Kent’s marriages.

I posted the following response to the above to the Wikipedia page:
“My apologies for my limited skills regarding Wikipedia features, but I was advised of this attempted edit and wish to protest the claims of Mary Tocco as false and/or misleading as a matter of law. Mary’s and Kent’s common law marriage in 2016 was legal and binding under Alabama law. Mary would do well to consult an attorney and obtain a similarly legal and binding divorce, as there is no provision for a common law divorce such as she claims.
